Terms of Service
These terms are the agreement between you and Yana. They cover what Yana is, what it is not, what we each agree to, and what happens when something goes wrong.

Agreeing to these terms
By creating a Yana account, or by using Yana, you agree to these terms and to our Privacy Policy. On our sign-in and sign-up screens you confirm this by ticking the agreement box, which is a valid acceptance under the Contract and Commercial Law Act 2017. If you do not agree, do not use Yana.
If you are agreeing on behalf of someone else — for example a person you care for, or a child under 16 — you confirm you are entitled to do so, and you accept these terms on their behalf as well as your own.
What Yana is
Yana is a personal medication and wellbeing tracker for people in New Zealand. It lets you record your medicines and doses, set reminders, keep track of vitals and check-ins, read plain-language information about medicines and common conditions, and — if you choose — share limited information with people you trust or with a pharmacy.
What Yana is not
- It is not a medical device, and it is not a substitute for advice from your pharmacist, doctor or nurse.
- It does not diagnose conditions, assess symptoms, calculate doses for you, or recommend that you start, stop or change any treatment.
- It is not an emergency or crisis service. Nothing you enter into Yana is monitored by a person, and no alert reaches a clinician.
- It is not your official health record. Your pharmacy, GP and hospital keep their own records, and Yana does not replace or update them.
- The medicine and condition information in Yana is general information, not advice about your situation. Always follow the directions on your own label and from your own prescriber.
You are responsible for what you enter and for the decisions you make about your own health. If what Yana shows you disagrees with what your pharmacist or prescriber has told you, follow your pharmacist or prescriber.
Reminders are best-effort
Reminders depend on things outside our control — your device’s settings, its battery and power-saving behaviour, your operating system, your network, and the notification services your device uses. A reminder can be late, or not arrive at all.
Do not rely on Yana as your only means of remembering a dose that matters. We do not guarantee delivery of any reminder, nudge or notification.
Your account
You need a free account to use the tracking features. You agree to give accurate details, to keep your sign-in credentials to yourself, and to tell us if you think someone else has got into your account. You are responsible for activity under your account.
Yana’s core features are currently free. If we introduce paid features, the price and terms will be shown to you before you buy anything, and nothing you already have will start charging without your agreement.
Sharing with other people
If you invite someone into your Care Circle, or link to a pharmacy, you are choosing to share information with them. You confirm that anyone whose details you enter — such as a Care Circle member’s name or phone number — has agreed to you providing them.
Care Circle members see whether doses were taken or not taken and when. They do not see medicine names or doses. A pharmacy sees the same timing information, and sees your medicine names only if you separately turn medication sharing on for that pharmacy. You can withdraw any of this at any time.
Care Circle members and pharmacies cannot change your medicines or your records through Yana.
Acceptable use
You agree not to:
- Use Yana for anyone else without their knowledge and agreement, or to monitor a person without their consent
- Try to access another person's account, records or Care Circle
- Interfere with, overload, probe or attempt to circumvent the security of the service
- Scrape, copy or redistribute the medicine and health content in bulk
- Use Yana to provide clinical services to other people, or to present its output as clinical advice
- Use Yana in a way that breaks New Zealand law
Our content, and your content
The Yana app, its design, and the medicine and health content in it are owned by us or our licensors and are protected by copyright. You may use them for your own personal, non-commercial use of Yana. Pharmacy accounts may use them for the ordinary operation of that pharmacy.
What you enter stays yours. You give us the permission we need to store it, process it, and show it back to you and to the people you have chosen to share it with, so we can run the service. How we may use information more broadly — including creating and using aggregated, de-identified information — is set out in the Privacy Policy, which forms part of these terms.
Availability and changes
We aim to keep Yana available, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features, and we may change these terms. If we make a significant change, we will surface it in the app or by email before it takes effect where we reasonably can. Continuing to use Yana after a change takes effect means you accept the updated terms.
Yana works offline, so your own device keeps your recent information even when the service is unavailable.
Your rights under New Zealand consumer law
If you are a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 give you guarantees and rights that cannot be excluded. Nothing in these terms limits or removes those rights. Everything below applies only to the extent the law allows.
If you use Yana for the purposes of a business — including a pharmacy using the pharmacy dashboard — you and we agree that the Consumer Guarantees Act does not apply, as permitted by section 43(2) of that Act.
Liability
To the extent the law allows, Yana is provided “as is”, and we are not liable for indirect or consequential loss, lost profits, or loss of data, arising from your use of Yana.
To the extent the law allows, our total liability to you for any claim connected with Yana is limited to the greater of the amount you have paid us in the twelve months before the claim, or NZ$100.
Nothing in these terms limits liability that cannot be limited by law — including liability for fraud, and rights under the Consumer Guarantees Act and Fair Trading Act described above.
Ending your account
You can delete your account at any time from your profile settings, or from our account deletion page. Deleting removes your account and the data attached to it, and cannot be undone.
We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law. Where it is reasonable to do so, we will tell you first and give you a chance to export your health summary.
Law and disputes
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If something goes wrong, contact us first — most things are fixable that way. If we cannot resolve it, a consumer claim can be taken to the Disputes Tribunal. A complaint about how we handle your personal information can go to the Office of the Privacy Commissioner, as described in the Privacy Policy.
General
If any part of these terms is found to be unenforceable, the rest keeps working. If we do not enforce a right straight away, we have not given it up. These terms, together with the Privacy Policy and the Cookies page, are the whole agreement between you and us about Yana.
